Conditions of Use

 Below you will find the three different types of use allowed on my site. Please refer to the terms of use for each kit in the description area of the kit and read the terms as described below for that particular kit. Most of my kits are now allowed for limited Commercial Use. In the future I will try to avoid using artists that do not allow for Commercial Use, as this is a reflection of the changing times and I strive to give my clients what they need. And as always all kits must be credited to the artist and to Art and Scraps.

Cheryl Seslar has her own specific terms of use and they must be followed. Most of her kits that I use will be labeled Commercial Use, although a few of them may be for Personal Use only. Please check to see that they are labeled for the purpose you need. If you are using commercial use kits then you must place her name on any items you create for sale such as artwork property of www.cherylseslar.com   and you must place my credits to www.artandcrafts.com

PLEASE NOTE: Cheryl Seslar and Clipart 4 Resale (Whimsy Primsy) do not allow you to give away any printables or graphics free to online groups or any closed membership type groups such as through Yahoo or Google. This is strictly prohibited.

Because of the many different artists work that I use in my kits, some of the terms and conditions for my kits will be different. When the kit is marked Personal Use Only in the description area of that kit than you need to follow the terms for the kit as described below under Personal Use terms of use.

If the Terms of Use are marked as Angel Use Policy Applies  in the description area of that kit than you need to follow the terms of use for the kit as described below under the Angel Use Policy terms of use.

 If the kit is marked Commercial Use Applies in the description are of that kit than you need to follow the terms of use for the kit as described below under the Commercial Use terms of use. 

Conditions of Use for Personal Use kits are as follows:This is for those kits marked PERSONAL USE ONLY.

All personal kits are for personal non-profit use only. Downloads of my kits must strictly be obtained using the download links on my site only. You may not distribute this kit or any of its pieces in any way. You may not claim any part of my kits as your own design or claim as your own work. They are not to be uploaded to personal sites or shared through yahoo or sharing type groups. You may use my creations to create quick pages provided proper credit is given and they are for non profit purposes only. Personal Use means only for your own personal use on your own home computer and printer. You may use the kits to create items for yourself and your family as gifts but may not be sold in any way. The files and kits may not be sold, given away, passed around through groups or made into digital files that are sold, given away or passed around through groups.

Conditions of use for my ANGEL USE TERMS are as follows:This is for those kits marked ANGEL USE TERMS APPLY ONLY.

When you purchase downloads you are buying a limited agreement to use my products according to my terms of use. By installing, using, printing and creating derivative works using my products purchased online at Art and Scraps, you agree that the designs and kits are the personal property of the artists and designers and are licensed to you as an individual user and are subject to the Angel Use Policy as outlined below:

1. You can copy and use the designs on your personal computer, or trace them onto a craft medium such as tin, wood, paper,etc for your own personal use.

2. You can print the artwork onto the following mediums using only your personal home printer. No commercial use printers, or presses are allowed under this policy. Printable mediums sized to fit your personal home printer such as paper, printable icing sheets, iron -on sheets, magnetic sheets, window clings, transparencies, and other printable mediums sized to fit and designed to be used in a personal home computer printer for your own personal use.

3. You can make one back up copy of the designs on cd disk or other memory device.

4. You must be a single employee craft shop (no other employees whatsoever) to make use of these Angel Policy terms. You must create your own sample photos of your completed craft item. Using Art and Scrap product shots is strictly forbidden and is a violation of our copyrights and trademarks.

5. You may create and sell completed tangible physical crafts and scrapbook layouts in a finished, flattened, printed out and assembled form. YOU MAY NOT SELL ANY DIGITAL SCRAPKIT products using my Angel Use kits. My angel use printables may not be resold on line as downloadable kits. They must be printed out and assembled only. And credit must be given to Art and Scraps .

6. Your products must be completed by your own hands and sold as a completed item. A kit is NOT a completed item and is NOT permitted.

7. You MAY make tangible  printables only, not digital downloads, using my Angel Use policy kits as long as my artist or designer credit or web address is clearly visible and legible on each piece. You must adhere to the 200 uses per image per calendar year.

8. Your handmade crafts or wrappers may be sold at craft fairs as long as you do not sell more than two hundred (200) products using the same image or design during the period of one (1) calendar year. If you are an Ebay seller you must provide copyright and  my web address  information in your auction descriptions.

9. In other words: You MAY use my Angel Use kits to create finished handmade, non digital items such as finished handmade greeting cards, scrapbook pages,and candywrappers to sell in craft fairs. You MAY NOT use my Angel Use kits to make other downloadable printable digital scrap kits and sell them anywhere.

10. If ever a question arises regarding the use of my kits please feel free to email me with your questions. You may reach me through the "Contact Us" button within this store. Please bear in mind that I use other artists artwork as well as my own and have to operate within their terms and abide by their own individual policies.

Conditions of Use for my COMMERCIAL USE POLICY is as follows. 

 This is for those kits marked as commercial use allowed.

 Kits can be used to create printables,greeting cards, and other printable crafts with the exception of digital scrap kits as those would be a direct conflict of interest with my own site. Also commercial use terms do NOT apply to cafe press, zazzle or similar type stores. Also digitizing for embroidery, cross stitch or similar type items is not allowed with the exception of for your own Personal Use. If you are unsure and it is not covered here, please do us both a favor and ask first, out of respect to the artists, and to avoid any future problems
